QUESTION NO. 1 (10 Marks)

A public limited company X Ltd. issued debentures to the public. The issue was oversubscribed. The company appointed Y Bank, a scheduled bank, to handle refund of excess application money and deposited ₹12 crores with the bank for that purpose.

Refund warrants were valid for three months. However, the bank continued to honour refunds even after expiry of validity and the company kept replenishing funds. The last refund was made on 30-11-2019.

In 2023, X Ltd. filed a suit against Y Bank seeking rendition of accounts and recovery of unrefunded money. The bank resisted the suit contending that:

  1. The suit is barred by limitation

  2. The money deposited no longer belongs to X Ltd.

  3. Certified statements of accounts under the Bankers’ Books Evidence Act are conclusive

Decide. Give reasons with reference to relevant provisions and case law.

QUESTION NO. 2 (25 Marks)

(a)

A made a clear admission in the written statement that he had received ₹10 lakhs from the plaintiff. Later, he filed an application seeking amendment of written statement to withdraw the admission, alleging it was made under mistake.

Can such amendment be allowed? Discuss with reasons and case law.

(b)

One co-owner has been in exclusive possession of joint family property for more than 25 years. He claims ownership by adverse possession against the other co-owners who were not in possession.

Can adverse possession be claimed merely on long exclusive possession? Explain.

(c)

Husband and wife were married in 1995. Husband underwent vasectomy in 2005. Parties continued to live together. In 2008, wife gave birth to a child. Husband seeks divorce on the ground of adultery.

Decide the claim with reasons.

(d)

A Hindu man claims that he married a Christian woman in a temple according to Hindu rites and seeks injunction restraining her from marrying another person.

Is the suit maintainable?

(e)

P, a Hindu male, died intestate leaving behind:

  • Widow

  • Mother

  • One son

  • One daughter

  • Widow and two children of a pre-deceased son

Determine the shares of all heirs.

QUESTION NO. 3 (Any FIVE – 3 × 5 = 15 Marks)

(a)

A thief sells stolen goods to B, who buys them in good faith. Can B acquire good title?

(b)

Goods sold were destroyed by fire after agreement but before delivery. Who bears the loss?

(c)

Buyer becomes insolvent after purchasing goods on credit. What are the rights of an unpaid seller?

(d)

The last date of limitation expired on a Sunday. Acknowledgment was made on the following Monday. Does it save limitation?

(e)

A mistake in payment was discoverable from the account books. Suit for recovery is filed after limitation, claiming benefit of Section 17 of Limitation Act. Decide.

(f)

What questions can be decided by the executing court under Section 47 CPC?

(g)

What is the effect of death of a party after final hearing but before pronouncement of judgment?

(h)

What is the scope of re-examination of a witness?
