(1) ARGUMENTS OF LAWYER – ENGLISH

May it please the Hon’ble Court,

False implication:
The applicant has been falsely implicated in the present case and has no direct role in the alleged offence.
Nature of offence:
The offence alleged is triable by a Magistrate / is not punishable with death or life imprisonment, therefore a liberal approach in bail is warranted.
Custody period:
The applicant is in judicial custody since ___, and further incarceration would serve no useful purpose.
Investigation completed / no recovery pending:
The investigation is complete / substantially complete and no further custodial interrogation or recovery is required.
No criminal antecedents:
The applicant has clean antecedents and is a law-abiding citizen.
No risk of absconding:
The applicant is a permanent resident of ___ and undertakes to appear before the Court on all dates of hearing.
No tampering with evidence:
There is no likelihood of the applicant influencing prosecution witnesses or tampering with evidence.
Bail is the rule:
It is settled law that “bail is the rule and jail is the exception” as held in State of Rajasthan v. Balchand.
Presumption of innocence:
The applicant is presumed innocent until proven guilty and pre-trial detention should not amount to punishment.
Undertaking:
The applicant undertakes to abide by all conditions imposed by this Hon’ble Court.

Therefore, it is humbly prayed that this Hon’ble Court may be pleased to grant bail to the applicant in the interest of justice.

માનનીય અદાલત સમક્ષ વિનમ્ર રજૂઆત છે કે,

ખોટી રીતે ફસાવવામાં આવ્યો છે:
અરજદારને હાલના ગુનામાં ખોટી રીતે ફસાવવામાં આવ્યો છે અને આરોપમાં તેની સીધી સંડોવણી નથી.
ગુનાની સ્વભાવ:
આરોપિત ગુનો ગંભીર શ્રેણીમાં આવતો નથી / મૅજિસ્ટ્રેટ સમક્ષ વિચારણીય છે, તેથી જામીન આપવા યોગ્ય છે.
કસ્ટડીનો સમયગાળો:
અરજદાર ___ તારીખથી ન્યાયિક કસ્ટડીમાં છે અને વધુ કસ્ટડીમાં રાખવાનો કોઈ ઉપયોગ નથી.
તપાસ પૂર્ણ / કોઈ વસૂલાત બાકી નથી:

અરજદાર માનનીય અદાલત દ્વારા મુકવામાં આવેલી તમામ શરતોનું પાલન કરશે.
