The defendant has preferred the present application under Order VII Rule 11(d) of the Code of Civil Procedure, 1908 seeking rejection of the plaint on the ground that the suit is barred by limitation.

The short contention of the defendant is that as per the averments in paragraph __ of the plaint, the cause of action arose on //20__, whereas the present suit came to be filed on //20__, beyond the prescribed period under the Limitation Act, 1963. It is submitted that the bar is apparent from the plaint itself.

Heard learned advocates for both sides. Perused the plaint.

It is well settled that while considering an application under Order VII Rule 11(d) CPC, the Court is required to examine only the averments made in the plaint and assume them to be correct. The defence taken in the written statement is wholly irrelevant at this stage. The Hon’ble Supreme Court in
Dahiben v. Arvindbhai Kalyanji Bhanusali
has held that if the suit appears from the statement in the plaint to be barred by any law, the plaint is liable to be rejected at the threshold. -
In the present case, the plaint itself states that the alleged agreement was terminated on //20__. No plea of acknowledgment, continuing cause of action, or exclusion of time has been pleaded. The suit having been filed beyond the statutory period, the bar of limitation is apparent ex facie.

The issue does not involve any disputed question of fact requiring evidence. The case squarely falls within clause (d) of Rule 11.

In view of the above discussion, the application succeeds.
ORDER
The application Exh. __ is hereby allowed.
The plaint in Civil Suit No. __ of 20__ stands rejected under Order VII Rule 11(d) CPC.
In view of Section 2(2) CPC, this order shall amount to a decree.
No order as to costs.
