The High Court held that: (i) destruction of the seized opium had not been proved in compliance with Section 52-A NDPS Act; and (ii) the prosecution failed to produce the seized contraband before the trial court, thereby undermining proof of seizure itself. The Union of India sought special leave to appeal.
