🔹 STAGE 1 – Date of Arrest

📌 Day 0 = Date of First Remand

  • Accused is arrested.

  • Produced before Magistrate within 24 hours.

  • Police or judicial custody begins.

  • Clock starts running under Section 167(2).


🔹 STAGE 2 – Statutory Period Calculation

Nature of Offence Maximum Time for Charge Sheet
Death / Life / Minimum 10 years 90 Days
All other offences 60 Days

📖 As clarified in Rakesh Kumar Paul (2017):
“Up to 10 years” → 60 days
“Not less than 10 years” → 90 days


🔹 STAGE 3 – Expiry of 60/90 Days

📌 On completion of 60th or 90th day:

👉 Indefeasible right to default bail accrues

But only if:

  • Charge sheet not filed

  • Accused applies for bail

  • Expresses readiness to furnish surety

🔹 STAGE 4 – Filing of Bail Application

Situation A

Accused files application AFTER expiry but BEFORE charge sheet:

✅ Right crystallizes
✅ Cannot be defeated by later filing of charge sheet


Situation B

Charge sheet filed BEFORE bail application:

❌ No default bail
❌ Right extinguished


🔹 STAGE 5 – Court’s Duty

Magistrate must:

  • Verify calculation of days

  • Check date of arrest

  • Check date of filing of charge sheet

  • Confirm readiness to furnish bail

Failure to grant = violation of Article 21.
